Terms and Conditions of Sale

These Terms and Conditions of Sale (“Conditions”) apply to purchases made through our Site. Please read these Conditions carefully before placing an Order. By confirming that you have read and accepted these Conditions when you place an Order through our Site, you confirm that you accept them unconditionally.

The contract can only be modified as a result of a mutual agreement reported in writing or via e-mail.

A copy of these Terms may be stored electronically or printed by all users of the Site.

INFORMATION RELATING TO THE PRODUCTS

We make every reasonable effort to ensure that the information relating to the Products is accurate and up to date. Any content present on the Site should not be understood as a binding representation or declaration relating to the Products. All images, illustrations and descriptions of the Products are for indicative purposes only and, since the colors you may actually see on our Site depend on your monitor, we cannot guarantee that the colors your monitor displays accurately reflect the colors of the products we will deliver to you. We reserve the right to change the information relating to the Products on the Site at any time and without notice, including, without limitation, the prices, descriptions and availability of the Products. In any case, such changes will not affect Orders that have already been accepted in accordance with Article 2 below.
The foregoing does not affect your mandatory rights relating to defective Products or Products that do not conform to those purchased.

HOW TO PLACE AN ORDER

To place an Order you must be at least 18 years old. To place an Order you must select the Products on the Site, select the delivery method you prefer and, of your choice, any optional services and select the "PROCEED TO CHECKOUT" command. Before completing the verification procedure (check-out) you will be asked to log in with your personal account or, alternatively (if you are not yet registered), to register a new one. If you prefer, you can complete the verification procedure (check-out) without registering, but you will be asked to enter your personal and payment details, necessary to place the Order.
We will not accept Orders placed in ways other than those described above. Orders will only be processed and Products delivered if we consider the Order to be complete. An Order is considered complete if all the required information has been correctly entered and these Conditions have been accepted.

When you place an Order, you make an offer to purchase the Products you have selected. Orders are subject to the availability of the Products and are subject to our approval. We may not accept your Order, at any time and at our discretion, if:
• You have provided incorrect information, such as, for example, incorrect or insufficient payment details, incorrect billing details; incorrect or incomplete shipping address or misleading information;
• There is an error on the Site relating to the Products you have ordered, for example an error relating to the price or description of the Products; or
• The Products you ordered are no longer available for sale through the Site;
• We believe you are not an adult.
We will not be liable to you or any third party for the withdrawal of any Product from the Site, for the removal or modification of the materials or content of the Site, for the refusal to execute an Order or for the suspension of the transaction once management of the same has begun for each of the above reasons.
If it is not possible to accept your Order, we will contact you via email or telephone as soon as possible, in any case no later than 30 (thirty) days from the date of your Order. If we are unable to accept or process your Order because the Products are no longer available or due to an error in pricing and/or other information relating to the Products you have ordered, we will contact you and suggest alternative products that you may like and you may want to buy. If you do not accept our suggestions, we will cancel your Order for the Products that we cannot supply and we will refund you within 14 (fourteen) days of the Order the sums you have already paid for such Products.
If you have placed the Order via the Site, you will receive an e-mail confirming that you have received your Order and which contains the details relating to the same (such as, for example, the quantity of the Products purchased, the price, the terms of delivery). This email does NOT represent acceptance of your Order. Unless you cancel your Order, the Order will be shipped. At that time you will receive an Order Shipping Confirmation email to inform you that we have shipped all or part of the Products you ordered.
Orders can be canceled at any time before being processed by the Company. If you wish to cancel your Order, please contact us using the contact details in the Contact section. We will not accept cancellations of Orders placed in ways other than those identified above. Once your Order has been processed, you will only be able to exercise your right of withdrawal according to the procedure described below.

WHAT HAPPENS IF THE PRODUCTS ARE NOT AVAILABLE

We use every reasonable effort to ensure that the information relating to the Products on the Site is accurate at all times. However, when you place an Order, certain Products may not be available.
If it is not possible to send you the Products ordered within 30 (thirty) days from the date of your Order, we will contact you and ask you if you intend to cancel your Order in whole or in part and, in this case, we will refund all sums paid for the Products included in the canceled Order. If we do not receive a response to the email or voicemail we may have left you, we will send you an email to let you know. If you do not contact us within 3 days of such last communication, we will cancel your entire Order and refund the price of the Products. None of the conditions herein reduce in any way your mandatory rights in relation to defective or non-compliant products with the products purchased. OUR PRICING POLICY

The prices of the Products are indicated on the Site and will be confirmed to you in the Order Confirmation that we will send you via e-mail.
All prices are in Euros and include VAT.
It is possible that shipping costs will be applied to your Order as indicated on the Site at the time you submit the Order. Shipping costs will depend on the value of your Order and the shipping method you have chosen. You can view the rates and delivery conditions by clicking here.
We reserve the right to change the price of the Products on the Site at any time and without notice. Changes to the price of the Products will not affect your Order that has already been accepted by the Company and for which we have already sent you the Order Shipping Confirmation.
If we discover an error in the price of the Products you have ordered, we will inform you as soon as possible by email or telephone and give you the choice of reconfirming your Order at the correct price or canceling your Order. If you cancel your Order, we will refund or credit you the amount you have paid for the Products for which you canceled the Order.

HOW CAN I MAKE PAYMENT

You can pay for the Products using a credit or debit card. We accept the main payment card circuits, such as Visa, Master Card. Payment takes place in the currency indicated in your Order before sending.
If you pay by credit or debit card, you will need to provide your card details when placing your Order, which will be charged, when we receive your Order, for an amount equal to the total value of your Order. We will not accept your Order, nor will we send the Products, until the issuer of your credit or debit card has authorized the transaction for the payment of the Products ordered. We will notify you immediately if we do not receive such authorization. We reserve the right to verify the identity of the credit or debit card holder by requesting the most appropriate information.
When paying via PayPal, you will be asked to log in to your account with your emails and password to confirm payment. If you don't have a PayPal account you can still make the payment via PayPal and you will be asked to enter your personal details and credit card details. The Products will be sent to you after completion of the payment transaction. If we do not receive payment within 30 days of the date of your Order, your Order will be canceled and you will receive an email confirming the cancellation of your Order.
The Products will be shipped to the address specified in the Order Confirmation. In any case, we can only send documents by e-mail to the address you provided to us at the time of the Order.

WHEN ARE THE PRODUCTS SHIPPED AND HOW CAN I TRACK THE STATUS OF MY ORDER

The shipment will take place, at your choice, via ordinary or express courier during office hours. Shipping costs may apply to your Order. We will not proceed with the shipment of the Products unless payment has been received. If no one is available to receive the Products delivered to the indicated delivery address, we will notify you via a notification left by the courier in your letterbox.
Title and risk of loss of the Products will pass to you upon delivery

HOW TO RETURN THE PRODUCTS

Please read our Returns Policy where you will find all the information necessary to return products for any reason.

YOUR RIGHT OF WITHDRAWAL

If you have received the Products ordered and are not satisfied or have simply changed your mind about the purchase after we have sent you your Order Shipping Confirmation by email, you can exercise your right of withdrawal without penalties and without indicating any reason and request a refund, pursuant to articles 64 et seq. of Legislative Decree 206/2005 (“Consumer Code”).
Please note that while the Products remain in your possession, you have an obligation to keep them safe and in good condition.

All products that undergo customization (specific customer request) cannot be returned.


After informing us of your decision to withdraw from the Contract, we will reimburse you as soon as possible, and in any case no later than 14 days from the date on which you exercised your right of withdrawal, any sum you have incurred or have been charged to you on the credit card for the Products ordered.

PROCESSING OF PERSONAL DATA

By placing an Order, you accept and understand that the Company may retain, process and use the data collected at the time of your registration on the Site in order to process your Order. MAJOR FORCE

We use all reasonable efforts to perform our obligations under these Terms. However, we will not be liable for delays or failures to perform if such delays or failures are caused by circumstances beyond our reasonable control including, without limitation, natural disasters, explosions, floods, fires or accidents; wars or civil unrest; strikes, industrial unrest or work stoppages; any form of government intervention; act or omission committed by a third party; non-compliance by our suppliers; errors in the delivery address or failure to notify changes to it, or failure to pay.
We will notify you of any unforeseen event as soon as possible after it has occurred and will perform our obligations as quickly as possible. If such interruption exceeds 2 (two) weeks, you will have the right to cancel the Order and a refund will be made to you in accordance with Article 9 of these Conditions.

APPLICABLE LAW

These Conditions are governed by Italian law (including, by way of example, articles 50 to 61 of Legislative Decree 206/2005 – Consumer Code – on distance contracts). Conflict of law regulations do not apply. To the extent permitted by applicable consumer protection laws, any action or dispute relating to these Conditions will be the exclusive jurisdiction of the Court of your residence or domicile, if located in Italy.

DEFINITIONS
